Terms of Service
The agreement between you and Netscope: what we provide, what you may do with it, and what happens when either side stops.
1. Who this is between
This agreement is between you — or the organisation you act for — and Robin Caboche, publisher of Netscope ("we", "us"). Creating an account means you accept these terms, the Acceptable Use Policy and, where we process data for you, the Data Processing Agreement. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.
You must be at least 16 years old to use Netscope.
2. What Netscope is
Netscope discovers and documents computer networks. You install an agent on infrastructure you control; it scans the networks you tell it to; the results are stored in your account and drawn as a topology you can annotate and share within your organisation.
3. The beta
Netscope is in open beta. During the beta:
- every feature is free, and we will not ask you for payment or card details;
- we give no undertaking about availability, performance or data retention, and features may change or be withdrawn;
- we may end the beta with at least 30 days' notice by email, during which you can export everything you have.
When we introduce paid plans, we will publish terms of sale and you will be asked to accept them separately. We will not convert a free account into a paid one without you choosing it.
4. Your account
- Give accurate registration details and keep your email address current.
- Keep your credentials to yourself. Everything done through your account is treated as done by you.
- Tell us at security@netscope.fr as soon as you suspect someone else has access.
- We strongly recommend enabling a second factor. An authenticator app or a security key is available in your settings at no cost.
5. What you may not do
The Acceptable Use Policy is part of this agreement and sets this out in full. In summary: scan only networks you own or are authorised in writing to scan, do not attempt to reach anyone else's data, and do not attack or overload the service.
You warrant that you are authorised to scan. Netscope sends traffic to hosts you nominate. You confirm that you own each network and host you target, or hold documented permission from whoever does, and that your use complies with the law where you and those hosts are. You indemnify us against any claim, loss or proceeding arising from scanning you were not authorised to perform. This is the single most important sentence in this agreement: unauthorised scanning is a criminal offence in France under articles 323-1 and following of the Penal Code, and in most other jurisdictions.
6. Who owns what
Your data stays yours. Your topologies, scan results, annotations and exports belong to you. We claim no ownership of them and use them only to provide the service and as set out in the Data Processing Agreement. You can export them at any time from your settings, and deleting your account deletes them.
Netscope stays ours. The platform, its source code, its interface, its documentation and its name remain our property. You get a personal, non-exclusive, non-transferable right to use the service while this agreement is in force. Nothing here transfers any intellectual property to you.
If you send us feedback or suggestions, we may use them freely, without owing you anything and without restriction. We will not identify you as their source without asking.
7. Availability
We aim to keep Netscope available, but during the beta we commit to no service level and give no undertaking about uptime. We may suspend the service for maintenance, and we will give notice where we reasonably can.
8. Suspending or ending an account
You can close your account at any time from your settings. It takes effect immediately, and your data is deleted within 30 days.
We may suspend or close an account:
- immediately, where it is being used to scan without authorisation, to attack the service, or for anything unlawful;
- on 30 days' notice, for any other material breach that you have not fixed after we asked you to;
- on 30 days' notice, if we discontinue the service.
Except where an account is closed for unauthorised scanning or an attack on the service, we give you 30 days to export your data before deleting it.
9. Liability
The service is provided as it is. To the extent the law allows, we exclude implied warranties of merchantability and fitness for a particular purpose.
Our total liability arising from this agreement is limited to the amounts you have paid us in the twelve months before the event giving rise to the claim — during the beta, when you pay nothing, to one hundred euros (€100).
We are not liable for indirect or consequential loss: lost profits, lost business, lost data where you could have exported it, or the cost of substitute services.
Nothing in this agreement excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence (faute lourde), or for anything else the law does not permit us to exclude. If a clause limiting our liability were to deprive this agreement of its essential substance, it does not apply.
10. Personal data
How we handle your personal data is set out in the Privacy Policy. Where we process data on your organisation's behalf, the Data Processing Agreement applies and forms part of this agreement.
11. Changing these terms
We may change these terms. For a change that materially affects your rights or obligations we will email you at least 30 days before it takes effect. Continuing to use Netscope after that date means you accept the new version; if you would rather not, close your account before then and export your data. The current version is 2026-09-04, shown at the top of this page.
Before we add a new sub-processor we will update the Sub-processors page and give you 30 days' notice, during which you may object by writing to privacy@netscope.fr. If we cannot resolve a reasonable objection, you may close your account and we will not treat that as a breach.
12. Law and jurisdiction
This agreement is governed by French law. If we cannot resolve a dispute between us, it goes to the competent French courts. If you are a consumer rather than a business, this does not deprive you of the protection of the mandatory rules of the country where you live.
13. Odds and ends
- If any part of this agreement is unenforceable, the rest continues, and that part is read as narrowly as necessary to make it work.
- Our not enforcing something on one occasion does not mean we have given it up for good.
- You may not transfer this agreement without our written consent. We may transfer it as part of a reorganisation or a sale of the business, and will tell you if we do.
- These terms, together with the Acceptable Use Policy, the Privacy Policy and, where it applies, the Data Processing Agreement, are the whole of what is agreed between us.
